1. Reservations, Orders, and Payments

When you make a reservation, place an order, or contract our catering or workshop services, you are entering into a binding agreement. For reservations and omakase seats, we may require a valid credit card to hold the booking. For private events and catering, we may request a deposit or full payment in advance to confirm services. Payment processing is performed by our third-party payment partners and their terms will apply to card transactions. Prices quoted are in Canadian dollars and include applicable taxes where indicated. Menu prices and availability may change due to seasonality and market supply. Special requests and dietary restrictions should be provided in writing as part of the booking or order so we can reasonably accommodate them. We will confirm bookings, deposits, and payment terms at the time of booking and provide receipts or invoices for payments received. Any additional charges incurred during service, such as extra guests or menu changes, will be reflected in a final invoice. You agree to provide accurate billing information and to notify us if payment details change.

2. Cancellations, Changes, and Refunds

Cancellations and modifications are governed by the terms provided at booking. For standard reservations, we request reasonable notice of changes or cancellations; last-minute no-shows and cancellations may be subject to a fee equal to a portion of the booking, particularly for omakase or preset tasting menus where ingredients are reserved. For private events and catering contracts, cancellation charges may apply based on the timing of notice and the commitments already made for staffing, ingredients, and suppliers. Any deposits taken are refundable only as specified in the booking agreement. Refunds, if applicable, will be processed to the original payment method within a reasonable timeframe and subject to any applicable processing fees. Refunds for ordered goods are provided in accordance with public health and safety rules and our quality standards. In the event we must cancel a service due to unforeseen circumstances such as extreme weather, supplier failure, or public health orders, we will offer alternative dates, credit, or a refund depending on the situation and the stage of preparation. We maintain clear cancellation terms in our booking confirmations; review them carefully when placing an order or reserving services.

3. Intellectual Property and Site Use

You may access the site and view materials for personal, non-commercial use only. Except for content explicitly identified as available for reuse, you must not copy, reproduce, distribute, modify, display, or create derivative works from the site content without prior written permission. If you post reviews, photos, or other user-generated content on our platforms, you grant Besto Sushi a non-exclusive, royalty-free, worldwide license to use that content for promotional and operational purposes. 4. Liability, Disclaimer, and Health Information

We strive to provide safe, high-quality food and accurate information. However, to the fullest extent permitted by law, Besto Sushi and its affiliates and suppliers disclaim all warranties, express or implied, regarding merchantability or fitness for a particular purpose. We will not be liable for indirect, incidental, special, or consequential damages arising from use of our site, products, services, or from a failure to accommodate a dietary restriction if such restriction was not disclosed at booking. While we take food safety seriously and follow strict handling and preparation practices, consuming raw or undercooked seafood carries inherent risks. Guests with severe allergies, compromised immune systems, or other health concerns should consult a physician before consuming raw products and must notify us in advance. We will use reasonable efforts to handle allergen requests, but cross-contact in a kitchen environment cannot be entirely eliminated. Our liability for any claim related to goods or services supplied will not exceed the amount paid for the relevant goods or services, except where applicable law provides otherwise. By using our services, you acknowledge these risks and agree to our terms of service and restaurant policies shared at the time of booking or purchase.

5. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada where applicable. Any dispute arising out of or relating to these Terms, the use of the website, or services provided will first be addressed through informal negotiation. If informal resolution is not possible, disputes shall be submitted to the courts located in Toronto, Ontario, and you consent to the exclusive jurisdiction of those courts. Where required by law, certain consumer protections will apply and may not be waived. If a provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect to the maximum extent permitted by law. We may update these Terms from time to time; when material changes are made we will post an updated version with a new effective date. Continued use of the site or services after such updates constitutes acceptance of the revised terms.
